  • Paid advertising (search & social media)

  • Content marketing

  • Branding & consulting

All services are provided based on agreed scope, timelines, and deliverables.

4. No Guarantee of Results

FORSBJ does not guarantee specific results, including but not limited to:

  • Search engine rankings

  • Ad performance or ROI

  • Sales or lead volume

Results depend on multiple external factors such as market conditions, competition, budget, and platform algorithms.

5. Client Responsibilities

The client agrees to:

  • Provide accurate and complete information

  • Approve deliverables in a timely manner

  • Provide required access (website, ads account, etc.)

  • Ensure compliance with applicable laws

Delays from the client side may impact project timelines and results.

6. Payments & Fees

  • All services require advance payment unless otherwise agreed

  • Payments are typically structured as full upfront or milestone-based

  • Late payments may result in service suspension

  • All fees are non-refundable unless stated otherwise in our Refund Policy

Currency: USD (unless agreed otherwise)

7. Third-Party Costs

Clients are responsible for third-party costs including:

  • Advertising budgets (e.g. ad spend)

  • Domain, hosting, or software tools

  • Paid plugins or subscriptions

These costs are non-refundable.

8. Intellectual Property

  • Upon full payment, ownership of final deliverables may be transferred to the client

  • FORSBJ retains rights to showcase completed work in its portfolio

  • Drafts, concepts, and unpaid work remain the property of FORSBJ

9. Confidentiality

Both parties agree to keep confidential information private and not disclose it to third parties without consent.

For sensitive projects, a separate NDA may be signed.

10. Limitation of Liability

FORSBJ shall not be held liable for:

  • Indirect or consequential losses

  • Loss of revenue, data, or profits

  • Platform account suspensions (e.g. ads accounts)

  • Results affected by external factors

All services are provided “as is” without warranties.

11. Indemnification

The client agrees to indemnify and hold FORSBJ harmless from any claims, damages, or legal issues arising from:

  • Client-provided content

  • Business practices

  • Violations of laws or platform policies

12. Termination

We reserve the right to suspend or terminate services if:

  • Payment is not received

  • Terms are violated

  • Client engages in illegal or unethical practices

Clients may also terminate services with written notice, subject to applicable policies.

13. Revisions & Scope Changes

  • Revisions are limited based on the agreed package

  • Additional work beyond scope will be charged separately

  • Major changes may require a new agreement

14. Communication

Official communication will be conducted via:

  • Email

  • Approved messaging platforms (e.g. WhatsApp, Slack)

Response times may vary based on working hours and workload.

15. Compliance with Laws & Platforms

Clients agree to comply with all applicable laws and advertising platform policies, including those of platforms like Google Ads and Meta Ads.

FORSBJ is not responsible for account suspensions due to policy violations.

16. Dispute Resolution

Any disputes arising from these Terms shall be resolved through negotiation. If unresolved:

  • Disputes shall be governed by the laws of Bangladesh

  • Arbitration may be used as the preferred resolution method

17. Force Majeure

FORSBJ shall not be liable for failure to perform due to events beyond reasonable control, including:

  • Natural disasters

  • Internet outages

  • Government actions

18. Changes to Terms

We reserve the right to update these Terms & Conditions at any time. Continued use of our services constitutes acceptance of the updated terms.
